“360 Snap & Stroll” – Terms and Conditions

1. Service Content and Specifications
   

   
   This service includes photography services inside the selected cable car cabin during the cable car journey from Tung Chung Cable Car Terminal to Ngong Ping Cable Car Terminal, as well as an outdoor photoshoot at Ngong Ping Village or nearby designated locations lasting 60 minutes (commencing from the first shooting location upon arrival at Ngong Ping Cable Car Terminal), covering approximately 4 to 5 photo spots. The shooting time includes walking time between photo spots and any waiting or rest time requested by the Guest. If delays caused by the aforementioned factors result in failure to reach 4 photo spots, Ngong Ping 360 and the photography service provider, Pictureworks, shall not provide any compensation of any nature.  The actual shooting duration shall be subject to on-site execution. Unless due to unforeseen circumstances or with the consent of both parties (the Guest and the photography service provider), the basic shooting duration shall not be altered.
   
   The delivered photography deliverables include: all digital original images (in JPEG format, no less than 50 HD 2400x1800px digital copies), 1 x 6R photo album, 8 x 6R printed photos, plus two mini-size printed photos containing 4 images each. 
   
   The maximum number of persons per photoshoot group is 6 (including any persons aged 3 or above). All members of the group must remain the same throughout the photography service; no additions or replacements are permitted. If such additions or replacements occur, the added or replaced persons will be counted as new members, which may incur extra charges.
   
   If any person is absent or leaves early before the scheduled end time of the photography service, no cancellation, rescheduling, or refund will be provided.
   
   Groups exceeding 6 persons must negotiate with Ngong Ping 360 in advance. If the number of Guests exceeds 6 persons, or exceeds the number agreed by Ngong Ping 360, Ngong Ping 360 reserves the right to suspend the photography service until the number of Guests is reduced to six persons or fewer.

2. Photo Storage, Delivery and Download Channels
   
   Storage Period and Platform: All digital original photos and retouched photos will be stored for 30 days on Ngong Ping 360's designated platform – the PictureAir System (a digital image service platform operated by the photography service provider), commencing 24 hours after the conclusion of the photoshoot. Thereafter, the system will automatically delete the photos, and no recovery service will be provided.
   
   Collection of Photography Deliverables: On the day of the photoshoot, the photography staff will escort the Guest to the photo service counter at Tung Chung Cable Car Terminal, Ngong Ping Cable Car Terminal, or the "#HONGKONG" souvenir shop at Ngong Ping Village to select the desired printed photos and collect the photography deliverables. A PictureAir card containing all digital original images will also be provided for downloading the photos.
   
   Authorized Download Channels: The customer may download the photos through the following official channels using the identity verification information registered at the time of booking (e.g., mobile verification code, last 4 digits of ID card number):
   1)    Official website: Pictureair.com; or
   2)    Mobile application of the photography service provider: PictureAir App (available for download on iOS App Store, Android Google Play, and the official app marketplace of the photography service provider); or
   3)    WeChat Mini Program: PictureAir WeChat Mini Program (searchable via WeChat "Mini Programs").
   
   The Guest may download the photos by following the steps on the photography service provider's official website, mobile application, or PictureAir WeChat Mini Program.
   
   Responsibility for Downloading: The customer must complete the download and backup within the 30-day storage period. If failure to complete the download and backup within the storage period occurs due to any personal reasons (such as operational delays, loss of account verification information, inability to access download channels, etc.), neither Ngong Ping 360 nor the photography service provider shall bear any liability.

3. Photo Usage Rights and Copyright Terms

   
   The Guest receives a personal, non-commercial right to use the photos, including but not limited to personal mementos, sharing with family and friends, and posting on non-commercial social media (e.g., WeChat Moments, Weibo, etc., subject to the rules of the applicable platform), without the need for separate application. When posting photos on social media platforms, the Guest bears full responsibility.
   
   The copyright of the photos belongs to the photography service provider (or the executing photographer). Unless otherwise agreed in writing at the time of booking, the customer shall not use the photos for any commercial purposes (including but not limited to online and offline advertisements, product packaging, commercial exhibitions, paid transfer, course instruction, etc.). For commercial use, a written application must be submitted to the photography service provider in advance, and the corresponding copyright fees must be paid according to the type of commercial use. Unauthorized commercial use will result in legal liability. The photography service provider's email address is: support@pictureair.com
   
   The customer must comply with all applicable laws and regulations when using the photos and must not infringe upon the lawful rights and interests of others. For example, if the photos contain unauthorized third-party portraits (other visitors, staff members, etc.), they shall not be publicly displayed or used for commercial activities. Any legal disputes (such as infringement of portrait rights, privacy rights, etc.) arising from the customer's unauthorized use of the photos shall be solely borne by the customer. Neither Ngong Ping 360 nor the photography service provider assumes any legal liability.

4. Booking and Rescheduling Rules
   
   This service must be booked through the official website of Ngong Ping 360 at least 7 working days in advance. At the time of booking, the customer must confirm the date, time slot, and number of persons for the photography service. A successful booking shall be deemed as mutual agreement to the arranged content. Unless otherwise agreed in writing by Ngong Ping 360 or in the event of force majeure, the Guest shall not request to change the date or time of the photography service, request a refund, or transfer the service to another person.
   
   If the cable car and photography services cannot be provided due to force majeure events (including but not limited to the Hong Kong Observatory issuing a Typhoon Signal No. 3 or above, a Red or Black Rainstorm Warning, suspension of cable car services, etc.), both parties may negotiate a free rescheduling or a full refund. Ngong Ping 360 shall not bear any other compensation liability.
   

5. Liability and Disclaimer Clauses
   
   Ngong Ping 360 will arrange for a professional photographer to provide the photography service and will ensure that the photographic equipment (cameras, lenses, flash units, etc.) is in normal working order. If the photographed images cannot be provided due to equipment malfunction or any technical issue, Ngong Ping 360 may, upon the Guest's request, arrange one complimentary photography service, limited to one time and one single photoshoot session.
   
   Ngong Ping 360 ensures that the photographed images will be uploaded to the three designated platforms (Pictureair.com, PictureAir App, PictureAir WeChat Mini Program) for the customer to download within the specified 30-day period. However, if the customer is unable to download the photos due to any failure of the network system security, platform maintenance, or the Guest's own equipment, Ngong Ping 360 shall not bear any liability. For any inquiries or technical support regarding photo download, the Guest may email the photography service provider at support@pictureair.com or submit an inquiry through the "Contact Us" page on the photography service provider's official website at https://www.pictureair.com/contact-us.
   
   During the photoshoot, the Guest must comply with the on-site rules of Ngong Ping 360 and the instructions of the photographer on site. If the Guest fails to cooperate with the relevant requirements (such as refusing to follow posing instructions, leaving the shooting area without authorization, causing delays to the shooting time, etc.) resulting in poor photography results or service delays, Ngong Ping 360 will not provide a retake or refund.
   
   During the photoshoot, Ngong Ping 360 assumes no liability for the personal safety of the Guest or the custody of their belongings. The Guest must at all times be mindful of their own safety and take proper care of their personal belongings, and should avoid carrying valuables during the photoshoot.
   
   

6. Other Terms
   
   Ngong Ping 360 and the photography service provider reserve the right to adjust the service content, prices, and these Terms and Conditions based on market changes, adjustments to venue rules, system upgrades, or other circumstances. The revised terms will be announced on official channels. New bookings shall be governed by the terms in effect at the time of booking; confirmed bookings shall remain subject to the original terms.
   
   By purchasing this service, the Guest agrees to all the Terms and Conditions set forth herein. Any changes to the service content must be agreed upon in writing by both Ngong Ping 360 and the Guest. All oral agreements shall be deemed invalid.
